Privacy Policy

Zngly, and our group of companies (“Zngly”, “we”, “us”, “our”) respects your privacy rights and is strongly committed to protecting your privacy online. Please read this Privacy Notice carefully to learn more about how we collect, store, use, disclose and transfer any information about you when you interact with us, or when you use any of our websites (“Sites“) or any related events, trade shows, sales or marketing, and/or if you use any of our products, services or applications (including any trial) (collectively the “Services”) in any manner. 

Scope

This Privacy Notice covers our processing of your Personal Information as a data controller. For example, when you are accessing or using our Sites or Services or when you contact us in any manner. In these situations, we gather various types of information from our users, customers and business contacts including information that identifies you as an individual, including your name, address and online identifiers (“Personal Information“). Please see the Data Collected section below for more information.

This Privacy Notice is not intended to cover the processing of Personal Information, which our Customers acting as data controller, share with us as their service provider. For example, this applies to Personal Information our Customers hold about their Customers, which they may share or make accessible to us through the use of our Services. In these situations, we will only process your Personal Information as data processor on behalf of our Customers. Please contact the data controller directly or visit their website to learn more about how they handle your Personal Information. 

Data Collected

We may collect any Personal Information that you choose to send to us or provide to us, for example, on our contact online form, by email or over the phone. If you contact us through the Sites, we will keep a record of our correspondence. We receive and store information you provide directly to us. For example, when you fill out a form through our websites, by email, or over the phone we collect Personal Information, such as name and e-mail address, to be able to contact you and/or send you information. The types of information we may collect directly from you include: name, username, email address, postal address, phone number, job title, as well as any other contact or other information you choose to provide us or upload to our systems in connection with the Services.

When you visit our Sites, we automatically collect certain information related to your device, such as your device’s IP address, referring website, which of our pages your device visited, and the time that your device visited our Site. We keep track of user activity in relation to the types of Services our customers and their users use, the configuration of their computers, type of browser and performance metrics related to their use of the Services.

Log information – we log information about our customers and their users when you use one of the Services including Internet Protocol (“IP“) address.

Information collected by cookies and other similar technologies – we use various technologies to collect information, which may include saving cookies to users’ computers.

Our use of Data

We will use the Personal Information we collect from you on our Sites for the following purposes:

  • To administer our Sites, our events and for internal operations, including troubleshooting, data analysis, testing, statistical and survey purposes;
  • To improve our Sites to ensure that content is presented in the most effective manner for you and for your computer;
  • Analyze customers’ use of the Sites for trend monitoring, marketing, remarketing and advertising purposes;
  • For purposes made clear to you at the time you submit your information – for example, to fulfill your contact request, to provide you with information you have requested about our Services; and
  • As part of our efforts to keep our Sites safe and secure.

In doing so, we will rely on our legitimate interests to provide and improve our Sites for our visitors. To the extent you provide your information to enquire about our Services, we will process your information with the view to entering into a contract with you, or your organisation (in which case legitimate interests will apply). If you provide your consent to receive marketing communications, we will rely on your consent for the processing of your Personal Information for marketing purposes.

We will use the Personal Information we collect from our customers and their users in connection with the Services we provide for the following purposes:

  • Set up a user account;
  • Provide, operate and maintain the Services;
  • Process and complete transactions, and send related information, including transaction confirmations and invoices;
  • Manage our customers’ use of the Services, respond to enquiries and comments and provide customer service and support;
  • Send technical alerts, updates, security notifications, and administrative communications; and
  • Investigate and prevent fraudulent activities, unauthorized access to the Services, and other illegal activities.

In doing so, our processing will generally be undertaken in accordance with our performance or entry into a contract with you, or your employer, including terms of use applicable to your use of the Site or Services. Our activities may also include broader processing activities on the basis of a legitimate interest relevant to our provision of Services to you (for example to understand your use of our Services, to respond to communications etc)., or processing necessary to comply with or enforce a legal obligation. The foregoing shall also apply to our processing of Personal Information relating to employees of our suppliers and broader business contacts, save that in those instances, we may be acting as customer in receipt of services.We may also use the information you send to us via our Sites and/or Services, to communicate with you via email and, possibly, other means, regarding products, services, offers, promotions and events we think may be of interest to you, if this is in accordance with your marketing preferences. However, you will always be able to opt-out of such communications at any time (see the Marketing Communications information under the “Your Privacy Rights” section below).

Legal basis for processing personal information

Our legal basis for collecting and using the Personal Information described above will depend on the Personal Information concerned and the specific context in which we collect it.  

However, we will normally collect Personal Information from you only where we have your consent to do so, where we need the Personal Information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms.  In some cases, we may also have a legal obligation to collect Personal Information from you or may otherwise need the Personal Information to protect your vital interests or those of another person.

If we ask you to provide Personal Information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your Personal Information is mandatory or not (as well as of the possible consequences if you do not provide your Personal Information).  

Similarly, if we collect and use your Personal Information in reliance on our legitimate interests (or those of any third party), we will make clear to you at the relevant time what those legitimate interests are.

Cookies

Our Sites and some of our Services use different types of cookies and other similar tracking technologies (like web beacons, tags and scripts) to uniquely identify your browser and to gather information about how you interact with the Sites and Services. Sharing Data and Third Parties

We do not rent or sell your Personal Information to anyone. We may share and disclose your information (including Personal Information) in the following limited circumstances:

To our group companies, vendors, consultants and other service providers:

We may share your information within our group, with third party vendors, consultants and other service providers who we employ to perform tasks on our behalf. These companies include (for example) CRM service providers, email service providers, business-oriented social networks and others.

Change of business ownership and control:

We may choose to buy or sell assets and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Apart from the instances listed above, Personal Information will be disclosed or transferred to third parties only when required by law, or to exercise establish or defend our legal rights

Data Security

We use appropriate technical, organizational and administrative security measures to protect any information we hold in our records from loss, misuse, unauthorized access, disclosure, alteration and destruction. Unfortunately, no company or service can guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. Among other practices, your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account. You agree to notify Zngly immediately of any unauthorized use of your account or password, or any other breach of security.

Transfer of Data

Some of the uses and disclosures mentioned in this Privacy Notice may involve the transfer of your Personal Information to various countries outside the UK and the European Economic Area (including the European Union) (“the EEA“). This section sets out the privacy principles we follow with respect to transfers of Personal Information outside of the UK and EEA. If we transfer your information outside of your country in this way, we will take steps to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this notice. Such measures may include by way of example, reliance on an adequacy decision, or entry into standard contractual clauses approved for use in your jurisdiction.

Under 18

We do not knowingly collect or solicit Personal Information from anyone under the age of 18. If you are under 18, please do not attempt to register for the Services or send any Personal Information about yourself to us. If we learn that we have collected Personal Information from a child under age 18, we will delete that information as quickly as possible. 

Storage

Zngly will store your Personal Information as long as it is reasonably necessary to fulfill the purposes for which it was collected (including, but not limited to, for the purpose of meeting any legal, accounting or other reporting requirements or obligations).  When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymise it or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

Your Rights

You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features.

You have the right of access, correction, erasure and objection to the use of your Personal Information. If you wish to contact Zngly regarding its use of your Personal Information, or if you no longer would like Zngly to process your Personal Information, or if you would like Zngly to restrict its processing in any manner, please email Zngly at info@zngly.com

Please note that an erasure of your Personal Information or a restriction of the processing of your Personal Information may mean that Zngly will not be able to provide its services to you, either in whole or in part. If you contact Zngly, please note the specific information you would like Zngly to consult, correct, update or delete and include a copy of a proper identification. Requests to delete Personal Information will be subject to any applicable legal and ethical reporting or document filing or retention obligations imposed on Zngly.

In addition, you may receive a copy of the Personal Information relating to you and information regarding Zngly’s processing of such Personal Information by applying to Zngly in writing using the address set out above. In such a case, Zngly will provide your Personal Information to you in a commonly used data format and you have the right to transmit that Personal Information to another data controller.

Marketing Communications

You can opt-out of receiving certain promotional or marketing communications from us at any time, by using the unsubscribe link in the emails communications we send or by contacting us at info@zngly.com with the word “UNSUBSCRIBE” in the subject field of the email. If you have any account for our Services, we will still send you non-promotional communications.

Changes to this Privacy Policy

We may update this Privacy Notice from time to time in response to changing legal, technical or business developments. When we update our Privacy Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make. This Notice was last updated in January 2022.
